Preamble

The International Alliance of Waste Pickers (IAWP), a global union federation representing waste pickers and their organisations across multiple countries, is committed to strengthening its institutional structure to effectively advance the rights, recognition, and livelihoods of waste pickers worldwide.

Recognising the need for a formal legal identity to enhance governance, financial management, global advocacy, and partnerships, the Executive Council has undertaken a process to identify an appropriate jurisdiction for IAWP’s legal incorporation.

The Executive Council acknowledges the comprehensive legal scoping exercise conducted by Suri & Sudhir Consultancy, as presented in the report titled “Legal Incorporation of the International Alliance of Waste Pickers (IAWP) – Jurisdictional Review and Recommendation,” which assessed potential jurisdictions including Chile, Canada, Kenya, and Mauritius.

The Executive Council further notes the comparative legal scoping undertaken by HomeNet International, which reviewed legal frameworks and requirements across a wide range of jurisdictions, including India, Bangladesh, Nepal, Bhutan, Cambodia, Chile, Indonesia, Kenya, Sri Lanka, Malaysia, Mauritius, Netherlands, South Africa, Singapore, Switzerland, the United Kingdom, the United States, Laos, Maldives, Nicaragua, Pakistan, the Philippines, Tanzania, and Thailand.

These analyses collectively highlight Mauritius as a jurisdiction offering relative ease of registration, favourable compliance requirements, administrative efficiency, and suitability for an international membership-based organisation such as IAWP.

Resolution

Therefore, the Executive Council of the International Alliance of Waste Pickers hereby resolves that:

1. Mandate for Registration
   The Executive Council mandates the IAWP Office Bearers to proceed with the legal registration and incorporation of the organisation in Mauritius. 
2. Scope of Authority
   The Office Bearers and General Secretary are authorised to:
   • Undertake all necessary legal, administrative, and financial procedures required for registration in Mauritius; 
   • Engage legal and professional services as required to complete the incorporation process; 
   • Finalise and submit all statutory documents, including constitution/bylaws aligned with IAWP’s governance framework; 
   • Ensure compliance with all applicable laws and regulations in Mauritius. 
3. Governance Alignment
   The registration process shall ensure that:
   • IAWP’s democratic, worker-led governance structure is preserved; 
   • The constitutional provisions adopted by the Congress and relevant policies approved by the Executive Council are reflected in the legal entity. 
   • Mechanisms for accountability, transparency, and representation of affiliates are upheld. 
4. Financial and Operational Implications
   The Office Bearers shall:
   • Allocate necessary resources within the approved budget for registration and associated costs; 
   • Report any significant financial implications to the Finance Subcommittee and Executive Council; 
   • Ensure that the registration strengthens IAWP’s ability to receive and manage funds in line with its mission. 
5. Reporting and Oversight
   The Office Bearers and General Secretary shall provide periodic updates to the Executive Council on:
   • Progress of the registration process; 
   • Key decisions taken during incorporation; 
   • Any challenges or risks encountered.
